Lost in the political discussions over the passage of the Trans-Pacific Partnership (TPP)—a trade agreement currently being negotiated in secret between the U.S. and 11 other Pacific-Rim nations—is the very real negative impact it would have on global health.

We are deeply concerned that the TPP, in its current form, will lock-in high, unsustainable drug prices, block or delay the availability of affordable generic medicines, and price millions of people out of much-needed medical care. Let’s talk a little about TPP and trade agreements in general:

– In general, trade agreements are good for all signatory countries.  They allow the member countries to move their competitive products and services into other member countries (which otherwise they may not be able to move, because of import tariff, import quota or other import barriers).

Dù Hiệp định Thương mại Xuyên Thái Bình Dương (TPP) có một số điều khoản có lợi cho kinh tế Việt Nam, nhưng cũng có vài điều khoản Việt Nam cần đặc biệt quan tâm đến. Trong số đó, điều khoản “Giải quyết Tranh Chấp giữa Nhà đầu tư và Quốc gia” (Investor-State Dispute Settlement, viết tắt là “ISDS”) là điều khoản sẽ ảnh hưởng trực tiếp đến chủ quyền tài phán quốc gia và làm suy yếu luật pháp quốc gia, đặc biệt là trong lãnh vực môi trường và y tế.

ISDS là điều khoản cho phép một công ty nước ngoài chống lại luật một quốc gia (như luật Việt Nam) và kiện chính phủ quốc gia đó (như chính phủ Việt Nam) qua một hội đồng xét xử theo quy định của hiệp ước (như TPP). Hội đồng xét xử này, có thể tạm gọi là hội đồng trọng tài, gồm các luật gia chuyên về luật công ty xét xử. Các luật gia này thường có khuynh hướng ủng hộ công ty. Hội đồng xét xử này không qua tòa án và luật lệ Việt Nam, và quyết định của họ không chống án được.
