At the end of a recent ASEAN-China summit in Kunming, China, on June 13, Beijing pressured several ASEAN members close to it to withdraw their support for an ASEAN joint press statement expressing “serious concerns” about recent developments in the South China Sea. These events raised fundamental questions about the ability of the grouping to pull together amid challenges posed by the region’s new strategic realities. A final ruling is expected soon from a tribunal at the Permanent Court of Arbitration in The Hague hearing Manila’s case against Beijing’s claims in the South China Sea. How many countries recognize the decision as legally binding on both parties and call for it to be respected will determine its ultimate value, as international pressure is the court’s only enforcement mechanism. In an effort to deflect that pressure, Chinese officials and state media have been trumpeting the number of countries that have voiced support for Beijing’s position that the tribunal lacks jurisdiction in the case and the ruling is therefore invalid. China’s Ministry of Foreign Affairs claims that number has climbed to 60, but has not provided a list of the countries or, in most cases, evidence for their support. Vietnam’s Island Building:
Double Standard or Drop in the Bucket?
China has sought to deflect criticism of its island building in the South China Sea by accusing other claimants, especially Vietnam, of doing the same. AMTI has examined each of the islets and reefs Vietnam occupies in the Spratly Islands and found evidence of reclamation at 10 of them. The images below suggest Vietnam has created just over 120 acres of new land in the South China Sea, mostly at Spratly Island, Southwest Cay, Sin Cowe Island, and West Reef. The issue has been given added urgency as bilateral relations have increasingly warmed and in light of shared U.S. and Vietnamese interests in preserving maritime security in the South China Sea. The United States and the European Union share similar interests and objectives in the Asia Pacific. Yet despite these shared goals, both powers have pursued independent – and at times competitive – policies in the region, which have on occasion hindered the realization of mutual strategic interests. As the United States and European Union deepen their engagement with the region and with key decisions looming on the horizon (notably regarding granting China market economy status and the Arbitral Tribunal’s ruling on territorial claims in the South China Sea), how can the transatlantic relationship be used more effectively to accelerate the region’s economic development, ensure the application of robust economic standards, strengthen the region’s institutional architecture, and uphold international legal principles?
