Poor governance stifling recovery

Economic growth has slowed in 2023 as tighter financial conditions weakened investment and consumer demand. Market adjustment to changing conditions in Vietnam has been held back by poor compliance with corporate reporting rules in both the private and public sectors.

Vietnam’s economic performance in 2022 beat expectations, lifted by strong export growth and a recovery in domestic consumption after the difficult years of the pandemic. Robust demand growth at home and abroad helped economic growth achieve 8.02 per cent for the year, second only to Malaysia in East and Southeast Asia.

Unfortunately, the rebound lost steam early this year. Demand in Vietnam’s main export markets weakened as central banks raised interest rates to control inflation. The Fed Funds rate – the interest rate at which the US Federal Reserve loans money to commercial banks – rose from near zero in April 2022 to 5 per cent last month, the highest in 15 years. Despite interest rate hikes, inflation has remained high around the world, even as energy prices moderated.

TAND Hà Nội đang nghỉ nghị án sau 12 ngày xét xử đại án “chuyến bay giải cứu“, sẽ tuyên án ngày 28/7. Nói những lời cuối, 21 cựu cán bộ thuộc Văn phòng Chính phủ, Bộ Ngoại giao, Bộ Công an, Bộ Y tế, Bộ Giao thông Vận tải, tỉnh Quảng Nam và Hà Nội đều xin lỗi, dành nhiều thời gian phân trần về động cơ khiến vướng lao lý.

Cựu thứ trưởng Ngoại giao Tô Anh Dũng khẳng định “chưa bao giờ đòi hỏi”, chỉ vì “nhận thức quá giản đơn, không phân phân biệt được ranh giới giữa nhận tiền cảm ơn và nhận hối lộ”.

Nói về số tiền bị cáo buộc nhận hối lộ 4,2 tỷ đồng, trước tòa, cựu trợ lý Phó thủ tướng Nguyễn Quang Linh cũng khai “nhận thức đơn giản”, cho rằng cứ giúp đỡ tận tâm, nhiệt tình, chu đáo, “doanh nghiệp làm ăn tốt sẽ nhớ đến mình”.

From pivotal legislative pushes in the U.S. and elsewhere, to ongoing probes into deposed leaders and tax dodgers, the impact of the largest ever offshore investigation is still being felt around the world.

n Oct. 3, 2021 — one year ago today — the International Consortium of Investigative Journalists and 150 media partners around the globe began rolling out the Pandora Papers, a world-rocking exposé that’s been called “a money bomb with political ripples,” “a financial earthquake” and “one of the essential stories of our time.”

The project took readers deeper than ever inside an offshore financial system that perpetuates corruption and authoritarianism and widens gaps between rich and poor. A U.S. senator called the investigation a “wake-up call to all who care about the future of democracy.”

More than 600 journalists at 151 news organizations in 117 countries worked together to make the Pandora Papers a reality — the largest collaboration in journalism history.

The Pandora Papers’ revelations about the financial secrets of prime ministers, oligarchs, mobsters and other powerful figures spawned action by governments and international groups, triggering investigations, legislation and rule changes in dozens of countries.

TTCTNếu như Trung Quốc có bao giờ thực hiện thành công một cuộc Đại nhảy vọt, thì đó chính là ở Thâm Quyến. Và lý do cơ bản của thành công này là vì thành phố này được phân quyền một cách đích thực.

Tôi vẫn còn nhớ cách đây khoảng 10 năm, một người bạn Hong Kong dẫn tôi tới dải đất sát bờ biển Hong Kong, chỉ vào một dãy nhà cao tầng san sát ở bờ bên kia và nói đó là thành phố Thâm Quyến.

Anh kể trước đây rất nhiều người Trung Quốc đại lục bị hấp dẫn bởi Hong Kong phồn hoa đã bơi từ Trung Quốc đại lục để vượt biên, nhập cảnh trái phép vào Hong Kong. Tôi bèn hỏi vui: “Bây giờ còn không anh?”. Anh trả lời rất nhanh: “Bên đó bây giờ thậm chí còn giàu hơn bên đây thì vượt biên làm gì”.

Địa phương hỏi trung ương quá nhiều, do đâu ?

Trong tháng năm vừa qua, TP. Hồ Chí Minh nổi lên như một ví dụ về sự bất lực của địa phương trong việc thực thi pháp luật. Năm 2022, thành phố này đã gửi gần 600 văn bản cho Bộ Kế hoạch và Đầu tư nhưng nhận lại được nhiều câu trả lời “không biết sao mà làm”. Đáp lại, Bộ Kế hoạch và Đầu tư lại chỉ trích thành phố là “né tránh, đá bóng”, đùn đẩy những gì thuộc trách nhiệm của mình sang cho Bộ.

Lỗi nằm ở cơ chế tập trung 

Khác với đa số các quốc gia trên thế giới, nguyên tắc phân định thẩm quyền giữa trung ương và địa phương nước ta là nguyên tắc “tập trung” (dù có kết hợp “phân quyền” nhưng không đáng kể). Điều đó có nghĩa là mối quan hệ giữa trung ương và địa phương về cơ bản là một chiều, từ trên xuống. Địa phương sẽ chỉ áp dụng và tổ chức thực hiện văn bản do trung ương ban hành và dưới sự giám sát, theo dõi của trung ương, bất kể nó có “độ lệch” với thực tế trên địa bàn của mình.

Seven years after the Panama Papers, the country sees a dramatic decrease in corporate registrations

Registrations of anonymous corporations in Panama have dropped by more than half in the last decade, according to a new investigation by Bloomberg Línea.

These corporations, known as sociedades anónimas, pay minimal to no tax and have served as the backbone of Panama’s offshore industry for decades.

A Bloomberg analysis based on data extracted from the Panamanian public registry shows a 63% decrease in registrations from 2012 to 2022, ICIJ member Mary Triny Zea reported. Similarly, the number of dissolutions of companies and private-interest funds per year has also increased; in 2013, there were seven. In 2022, that number had jumped to 5,575.

Bloomberg’s analysis also included data on Delaware and the British Virgin Islands – two other secrecy jurisdictions long considered competitors to Panama. While the British Virgin Islands also saw a decrease in company registrations over the last decade, registrations in Delaware have steadily risen over the past decade, with 62,510 new ones in 2021. The U.S. currently tops the Financial Secrecy Index, the Tax Justice Network’s ranking of jurisdictions most complicit in helping people hide their finances.

Panama Bar Association president Juan Carlos Araúz attributes this change in the country  to its poor reputation after the ICIJ’s Panama Papers investigation. That investigation, based on 11.5 million leaked records from the now defunct Panamanian law firm Mossack Fonseca, blew open a system of offshore banking that enabled tax avoidance, money laundering and corruption.

“Despite the efforts Panama has made to set a standard of control at a higher level than any other jurisdiction in the world, it’s still impacted by the country’s reputation,” Araúz told Bloomberg.

The same year ICIJ published the Panama Papers, 2016, Panama saw its highest number of anonymous corporation dissolutions in the last decade: 14,172. More recently, the Panamanian government has cracked down on the industry, suspending – and then dissolving – hundreds of thousands of companies, mostly for not paying fees.

Mayra Rodríguez, a Panama-based lawyer, also credited ICIJ’s investigation but argued the decline could be due to increased regulations implemented as a result. These regulations impose higher obligations on law firms, which Rodríguez says increases risk and potentially drives down demand.

Similarly, pressure from international entities such as the Financial Action Task Force may have also contributed to the change. Panama is currently on the FATF’s “greylist” – a list of jurisdictions that the organization monitors closely and which have agreed to resolve certain financial loopholes within a specific time frame.

FATF has tasked Panama with ensuring “adequate verification of up-to-date beneficial ownership information by obliged entities and timely access by competent authorities.” And the window of time to do so is closing soon. The FATF has issued a warning to Panama to complete the country’s action plan by June 2023, or face further censure by the organization and its members.

Nhũng nhiễu tăng vọt

Giám đốc một doanh nghiệp tại Hà Nội cho biết, công ty ông phải tiếp các đoàn thanh tra khá thường xuyên. Mà trong mỗi lần kiểm tra thì y như rằng, họ yêu cầu, xét nét đủ thứ, không có “phong bao” thì không được. Có cán bộ còn chủ động xin số zalo để kết nối dễ, mỗi lần “có việc” là họ lại chủ động liên hệ “xin”.

Đây chính là hành vi nhũng nhiễu, hay nói chính xác là tham nhũng vặt, của những người có chức vụ, quyền hạn, nhằm vụ lợi từ doanh nghiệp. Những hành vi này đã diễn ra từ lâu và diễn ra hàng ngày ở nhiều nơi, nhiều cơ quan, tổ chức khác nhau, thậm chí gần như trở thành thông lệ, thói quen, của không ít cán bộ hiện nay.

Understanding Causes for Wrongful Convictions in Vietnam: a View from the Top and the Bottom of the Iceberg

Abstract

Wrongful convictions have severe consequences and effects on the values, dignity, and self-esteem of the innocent and their beloved ones. While Vietnam is implementing the rule of law to ensure the protection of citizens’ fundamental rights, recent and serious wrongful conviction cases suggest a need to enhance the effectiveness and credibility of criminal justice reform. Using several cases for examples from Vietnam, this study examines two levels of factors that contribute to wrongful convictions: (i) the acknowledged causes (the top of the iceberg) and (ii) the hidden roots (beneath the surface). In addition, we compare the case of Vietnam to the findings from other Asian nations, notably those of East Asia. We conclude that the causes for wrongful convictions are embedded in the criminal justice process and culture, and eradication of wrongful convictions requires careful planning and innovative reforms that address the root causes of the problems. Relevant policy and practical recommendations are offered to deal with the factors leading to wrongful convictions in Vietnam.

Introduction

In recent years, Vietnam’s criminal justice system has been more effective in addressing human rights and responding to transnational crimes and maintaining national security. New legislation in Vietnam’s criminal justice system sets the goals of safeguarding justice and human rights first and foremost, a component of which requires reduction of wrongful convictions. Wrongful convictions have weakened public trust in the criminal justice system, violated human rights, and affected the integrity of the rule of law. Yet, at the domestic level, wrongful convictions are still persistent.

Vietnamese legal scholars have started examining wrongful convictions, particularly after the Communist Party of Vietnam (CPV) called for judicial reforms in the 2000s (Dao, 2020; Thai, 2020). These scholars have paid little attention, however, to the fundamental reasons that lead to wrongful convictions. While the CPV encouraged the combination of inquisitorial and adversarial models in criminal proceedings, the legal ideology to identify and recognize hidden factors of wrongful convictions has not been seriously considered in the process. In other words, the hidden factors contributing to wrongful convictions are still not reviewed and assessed alongside the surface elements of wrongful convictions in Vietnam.

Nhiệm vụ đảm bảo an toàn hàng không là nhiệm vụ sống còn, là bộ phận quan trọng đặc biệt trong công tác đảm bảo an ninh quốc gia, giữ gìn trật tự xã hội của đất nước. Nhưng thực tế, phóng viên Báo Đại Đoàn Kết phát hiện hàng loạt đường dây hỗ trợ bay cho hành khách không giấy tờ tuỳ thân, gióng lên ‘hồi chuông’ báo động về ‘lỗ hổng’ an toàn hàng không.

Hành khách xếp hàng để kiểm tra giấy tờ tuỳ thân tại cửa kiểm soát trước khi lên máy bay tại sân bay Đà Nẵng.

Theo quy định, nếu không có giấy tờ tùy thân thì hành khách không đủ điều kiện lên máy bay nhưng qua đường dây hỗ trợ bay trên mạng, hành khách chỉ cần chuyển khoản đến các đại lý bán vé từ 1-3 triệu đồng sẽ được ‘tạo điều kiện’ bay nội địa trên các chuyến của các hãng hàng không: Vietnam Airlines, Bamboo Airways, Vietjet Airlines, Jetstar Pacific.
