Australia urges South China Sea ruling as basis for ‘code of conduct’

MANILA: The Association of Southeast Asian Nations should use an international court’s rejection of China’s claims to almost all the South China Sea as basis for a code of conduct, Australian Foreign Minister Julie Bishop said on Thursday.

Australia did not take sides in the South China Sea disputes, Bishop said, but it wanted to see “de-escalation of tension”, reiterating its opposition to China’s militarisation of man-made islands in the waters.

Bộ Nông nghiệp Trung Quốc ngày 27/2 đơn phương thông báo lệnh cấm đánh bắt cá ở Biển Đông từ 12h ngày 1/5 đến 12h ngày 16/8. Phạm vi cấm đánh bắt cá do Trung Quốc đơn phương vạch ra trên Biển Đông là từ 12 độ vĩ Bắc đến Vịnh Bắc Bộ và “giao tuyến hải vực Mân Áo”, tức vùng biển từ Phúc Kiến đến Quảng Đông, tọa độ từ 117º31’37.40″E，23º09’42.60″N đến 120º50’43″E，21º54’15″N). Lệnh cấm này cũng được áp dụng ở Vịnh Bắc Bộ, vùng biển Bột Hải, Hoàng Hải và Đông Hải.

China claims they aren’t military bases, but their actions say otherwise.

China is building islands in the South China sea and its causing disputes among the other nations in the region; Malaysia, the Philippines, Brunei, Vietnam, and Indonesia. The US has many allies in the region and uses its massive Navy to patrol international waters, keeping shipping lanes open for trade.

One of America’s top military commanders has painted a bleak picture of the Asia-Pacific, declaring freedom, justice and the rules-based international order hang in the balance.

Admiral Harry Harris, head of the US Pacific Command, told a conference in San Diego the path to stability in the region faces four considerable challenges: North Korea, China, Russia and Islamic State.

Since the arbitral tribunal formed pursuant to the UN Convention for the Law of the Sea (UNCLOS) handed China a stunning legal defeat in July, China has loudly proclaimed its intention to ignore the arbitral award.  For most analysts of the region, it has been a working assumption that China has not and will not comply with any parts of the award.   But China’s statements that it will ignore the award do not necessarily mean that it is currently in complete non-compliance or that it will never come into compliance in the future.  China’s actions, as opposed to terse public statements, must be assessed as a measure of its compliance. chathamhouse – Despite its dramatic rejection of the South China Sea arbitration case initiated by the Philippines, China is gearing up to play a much larger role in the evolution of the international legal system.

It is tempting to read China’s refusal in this case to acknowledge the jurisdiction of the arbitral tribunal in The Hague as the defiance of an arrogant superpower that views itself as above international law. No doubt many in Manila, Washington and elsewhere are purveying this view. But there is more here than meets the eye.
