Donald Trump’s packing of the supreme court, to which he appointed three members, to create a reliable conservative majority, has been hailed by the right as his greatest achievement. The Wall Street Journal editorial page has stated that the most important prospect of a second Trump term would be his appointment of federal judges in their mold. But Trump’s candidacy for that second term now poses an existential threat to the legitimacy of the court’s conservative majority.

1. The Court shall have jurisdiction in respect of war crimes in particular when committed as part of a plan or policy or as part of a large-scale commission of such crimes.1. (vi) Wilfully depriving a prisoner of war or other protected person of the rights of fair and regular trial;

(vii) Unlawful deportation or transfer or unlawful confinement;

(viii) Taking of hostages.

(b) Other serious violations of the laws and customs applicable in international armed conflict, within the established framework of international law, namely, any of the following acts:

(i) Intentionally directing attacks against the civilian population as such or against individual civilians not taking direct part in hostilities;

(ii) Intentionally directing attacks against civilian objects, that is, objects which are not military objectives;

(iii) Intentionally directing attacks against personnel, installations, material, units or vehicles involved in a humanitarian assistance or peacekeeping mission in accordance with the Charter of the United Nations, as long as they are entitled to the protection given to civilians or civilian objects under the international law of armed conflict;

(iv) Intentionally launching an attack in the knowledge that such attack will cause incidental loss of life or injury to civilians or damage to civilian objects or widespread, long-term and severe damage to the natural environment which would be clearly excessive in relation to the concrete and direct overall military advantage anticipated;

(v) Attacking or bombarding, by whatever means, towns, villages, dwellings or buildings which are undefended and which are not military objectives;

(vi) Killing or wounding a combatant who, having laid down his arms or having no longer means of defence, has surrendered at discretion;

(vii) Making improper use of a flag of truce, of the flag or of the military insignia and uniform of the enemy or of the United Nations, as well as of the distinctive emblems of the Geneva Conventions, resulting in death or serious personal injury;

(viii) The transfer, directly or indirectly, by the Occupying Power of parts of its own civilian population into the territory it occupies, or the deportation or transfer of all or parts of the population of the occupied territory within or outside this territory;

(ix) Intentionally directing attacks against buildings dedicated to religion, education, art, science or charitable purposes, historic monuments, hospitals and places where the sick and wounded are
collected, provided they are not military objectives;

(x) Subjecting persons who are in the power of an adverse party to physical mutilation or to medical or scientific experiments of any kind which are neither justified by the medical, dental or hospital treatment of the person concerned nor carried out in his or her interest, and which cause death to or seriously endanger the health of such person or persons;

(xi) Killing or wounding treacherously individuals belonging to the hostile nation or army;

(xii) Declaring that no quarter will be given;

(xiii) Destroying or seizing the enemy’s property unless such destruction or seizure be imperatively demanded by the necessities of war;

(xiv) Declaring abolished, suspended or inadmissible in a court of law the rights and actions of the nationals of the hostile party;

(xv) Compelling the nationals of the hostile party to take part in the operations of war directed against their own country, even if they were in the belligerent’s service before the commencement of the war;

(xvi) Pillaging a town or place, even when taken by assault;

(xvii) Employing poison or poisoned weapons;

(xviii) Employing asphyxiating, poisonous or other gases, and all analogous liquids, materials or devices;

(xix) Employing bullets which expand or flatten easily in the human body, such as bullets with a hard envelope which does not entirely cover the core or is pierced with incisions;

(xx) Employing weapons, projectiles and material and methods of warfare which are of a nature to cause superfluous injury or unnecessary suffering or which are inherently indiscriminate in violation of the international law of armed conflict, provided that such weapons, projectiles and material and methods of warfare are the subject of a comprehensive prohibition and are included in an annex to this Statute, by an amendment in accordance with the relevant provisions set forth in articles 121 and 123;

(xxi) Committing outrages upon personal dignity, in particular humiliating and degrading treatment;

(xxii) Committing rape, sexual slavery, enforced prostitution, forced pregnancy, as defined in article 7, paragraph 2 (f), enforced sterilization, or any other form of sexual violence also constituting a grave breach of the Geneva Conventions;

(xxiii) Utilizing the presence of a civilian or other protected person to render certain points, areas or military forces immune from military operations;

(xxiv) Intentionally directing attacks against buildings, material, medical units and transport, and personnel using the distinctive emblems of the Geneva Conventions in conformity with international law;

(xxv) Intentionally using starvation of civilians as a method of warfare by depriving them of objects indispensable to their survival, including wilfully impeding relief supplies as provided for under the Geneva Conventions;

(xxvi) Conscripting or enlisting children under the age of fifteen years into the national armed forces or using them to participate actively in hostilities.

(c) In the case of an armed conflict not of an international character, serious violations of article 3 common to the four Geneva Conventions of 12 August 1949, namely, any of the following acts committed against persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed hors de combat by sickness, wounds, detention or any other cause:

(i) Violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture;

(ii) Committing outrages upon personal dignity, in particular humiliating and degrading treatment;

(iii) Taking of hostages;

(iv) The passing of sentences and the carrying out of executions without previous judgement pronounced by a regularly constituted court, affording all judicial guarantees which are generally recognized as indispensable.

(viii) Ordering the displacement of the civilian population for reasons related to the conflict, unless the security of the civilians involved or imperative military reasons so demand;

(ix) Killing or wounding treacherously a combatant adversary;

(x) Declaring that no quarter will be given;

(xi) Subjecting persons who are in the power of another party to the conflict to physical mutilation or to medical or scientific experiments of any kind which are neither justified by the medical, dental or hospital treatment of the person concerned nor carried out in his or her interest, and which cause death to or seriously endanger the health of such person or persons;

(xii) Destroying or seizing the property of an adversary unless such destruction or seizure be imperatively demanded by the necessities of the conflict;

(xiii) Employing poison or poisoned weapons;

(xiv) Employing asphyxiating, poisonous or other gases, and all analogous liquids, materials or
devices;

2. Paragraphs 2 (e) (xiii) to 2 (e) (xv) were amended by resolution RC/Res.5 of 11 June 2010 (adding paragraphs 2 (e) (xiii) to 2 (e) (xv)).

The Responsibility to Protect – known as R2P – is an international norm that seeks to ensure that the international community never again fails to halt the mass atrocity crimes of genocide, war crimes, ethnic cleansing and crimes against humanity. The concept emerged in response to the failure of the international community to adequately respond to mass atrocities committed in Rwanda and the former Yugoslavia during the 1990s. The International Committee on Intervention and State Sovereignty developed the concept of R2P during 2001.

The Responsibility to Protect was unanimously adopted in 2005 at the UN World Summit, the largest gathering of Heads of State and Government in history. It is articulated in paragraphs 138 and 139 of the World Summit Outcome Document:

Resurfaced maps showing the heavy Cold War bombardment of Laos have fed the controversial legacy of diplomatic giant Henry Kissinger following his death.

Kissinger, a former secretary of state and national security adviser who is credited with shaping decades of U.S. foreign policy, died at his Connecticut home aged 100 on Wednesday.

Kissinger “played central roles in the opening to China, negotiating the end of the Yom Kippur War in the Middle East, and helping to bring America’s role in the Vietnam War to a close,” the diplomat’s international geopolitical consulting firm said in a statement on his passing.

The influential diplomat won the 1973 Nobel Peace Prize along with Vietnamese diplomat Le Duc Tho “for jointly having negotiated a cease-fire in Vietnam in 1973.” The latter declined the prize.

But as tens of thousands of U.S. soldiers died in Vietnam, anger in the U.S. was also spurred on by the extensive bombing of neighboring countries Laos and Cambodia.

The U.S. was attempting to disrupt a logistics chain — known as the Ho Chi Minh trail — running from Laos into Vietnam, which was used by North Vietnamese forces.

Laos is the most bombed country in the world. Between 1964 and 1973, the U.S. dropped more than 270 million bombs on the country, which had a population of around 3 million at the time.

U.S. aircraft dropped a new wave of bombs on Laos every eight minutes for nearly 10 years on average.

Queen Rania Al Abdullah of Jordan has called for a ceasefire in Israel’s war against Hamas, saying that supporting the protection of Palestinian lives does not equal being antisemitic or pro-terrorism.

“Let me be very, very clear. Being pro-Palestinian is not being antisemitic, being pro-Palestinian does not mean you’re pro-Hamas or pro-terrorism,” Rania told CNN’s Becky Anderson on Sunday.

“What we’ve seen in recent years is the charge of antisemitism being weaponized in order to silence any criticism of Israel,” she said.

“I want to absolutely and wholeheartedly condemn antisemitism and Islamophobia…but I also want to remind everyone that Israel does not represent all the Jewish people around the world. Israel is a state and is alone is responsible for its own crimes.”

While aid workers serving conflict-affected civilian populations depend on a set of laws to protect them, some warring parties violate these global agreements, from targeting hospitals and schools to blocking aid workers from reaching civilians with lifesaving goods and services.

But, what exactly are the rules of war and what happens when they are broken?

To find out more about international humanitarian law, known by its acronym IHL, UN News spoke with Eric Mongelard at the UN human rights office, OHCHR.

Here’s what you need to know:

Rules of war

International humanitarian law is as old as war. From passages in the Bible and Quran to medieval European codes of chivalry, this ever-growing set of rules of engagement aims to limit a conflict’s effects on civilians or non-combatants.

The laws represent “the very minimum rules to preserve humanity in some of the worst situations known to mankind,” Mr. Mongelard said, noting that the rules of war apply the moment an armed conflict has begun.

1. Quốc triều hình luật (hay còn gọi là Lê triều hình luật) được xây dựng, bổ sung, hoàn chỉnh trong các triều đại phong kiến Việt Nam thời Lê sơ. Bộ luật này được vua Lê Thánh Tông ban hành vào năm 1483  trong thời gian ông lấy niên hiệu là Hồng Đức (1470-1497), nên trong dân gian và trong sử sách vẫn thường gọi bộ luật này là Luật Hồng Đức(1).

Tất nhiên, cho đến nay, vẫn còn có nhiều ý kiến khác nhau về thời điểm khởi thảo và thời điểm hoàn chỉnh bộ luật này. Trong thiên Hình luật chí (sách Lịch triều hiến chương loại chí), Phan Huy Chú cũng như dựa trên nhiều nguồn tư liệu khác và theo quan điểm chung của nhiều nhà nghiên cứu thì bộ luật này được xây dựng trên cơ sở sưu tập tất cả các điều luật, các văn bản pháp luật đã ban bố và thi hành trong các đời vua trước đây, được sửa chữa, bổ sung và san định lại cho hoàn chỉnh(2). Song, trong Lời nói đầu của cuốn Quốc triều hình luật do Viện Sử học Việt Nam dịch và giới thiệu thì bộ luật trên có thể được soạn thảo ngay năm đầu của triều Lê sơ (Lê Thái Tổ) và “không ngừng được các triều vua kế tiếp bổ sung, hoàn chỉnh dần, trong đó chắc chắn là có những đóng góp to lớn của ông vua nổi tiếng văn hiến Lê Thánh Tông”(3). Có thể khẳng định rằng, Luật Hồng Đức là bộ luật tiến bộ nhất, hoàn chỉnh nhất trong các bộ luật ở Việt Nam thời phong kiến; là thành tựu có giá trị đặc biệt trong lịch sử pháp luật Việt Nam; là một trong những thành tựu tiêu biểu của nền văn hiến nước ta. Bộ luật ấy chứa đựng nhiều giá trị nhân văn sâu sắc và nội dung tư tưởng rộng lớn, là cơ sở nền tảng trong việc xây dựng nhà nước phong kiến thịnh trị thời Lê sơ.

Bộ luật Hồng Đức là 1 trong 4 bộ tổng luật thành văn trong lịch sử lập pháp Việt Nam (cùng với bộ Hình thư thời Lý, bộ Quốc triều thông chế thời Trần và bộ Hoàng Việt luật lệ thời Nguyễn). Bộ luật Hồng Đức là sản phẩm của việc pháp điển hóa pháp luật thời Lê sơ, hiệu lực của nó không chỉ duy trì trong hơn 300 năm thời Hậu Lê; mà kể cả thời Nguyễn sau này hay hệ thống pháp luật Việt Nam hiện đại cũng đã kế thừa nhiều thành tựu lập pháp trong bộ luật Hồng Đức.

Bộ luật Hồng Đức bao gồm 722 điều, chia thành 13 chương; nhưng không phải tất cả các điều luật này đều được ban hành trong thời kì Hồng Đức (1470-1497). Ví dụ, điều 388 bộ luật Hồng Đức được ban hành vào năm Quang Thuận thứ 2 (1461); điều 389 bộ luật Hồng Đức được ban hành vào năm Hồng Thuận thứ 3 (1511), điều 391 bộ luật Hồng Đức được ban hành vào năm Quang Thiệu thứ 2 (1517)…

Ngày nay, hơn hai phần ba các quốc gia trên thế giới đã trở thành những quốc gia bãi bỏ trong luật pháp hoặc trên thực tiễn, điều này khẳng định xu hướng toàn cầu ủng hộ việc bãi bỏ án tử hình. Không có bằng chứng nào cho thấy hình phạt tử hình có tác dụng răn đe tội phạm hiệu quả hơn hình phạt tù. Hơn nữa, việc cải tạo với vai trò như một mục tiêu của luật hình sự hiện đại không thể thực hiện được bằng việc áp dụng hình phạt tử hình. Không những thế, bất kỳ sai sót nào – điều không thể tránh khỏi trong bất kỳ hệ thống luật pháp nào – đều không thể đảo ngược. 

Chúng tôi sẽ tiếp tục tích cực nỗ lực để thúc đẩy xu hướng chung hướng tới loại bỏ hình phạt tử hình và sẵn sàng hỗ trợ Việt Nam trên con đường tiến tới việc xóa bỏ này.

The 2030 Agenda for Sustainable Development was adopted by all United Nations’ (UN) member states in 2015. “A shared blueprint for peace and prosperity for people and the planet, now and into the future”, it is based on 17 Sustainable Development Goals (SDGs), which the UN describes as an urgent call for action. The organization says that ending global poverty requires focusing on strategies that reduce inequality and spur economic growth, while also tackling climate change.

The Sustainable Development Goals Report 2022 painted a worrying picture of progress in almost all areas, but the 2023 update delivers an even graver warning: “The promises enshrined in the SDGs are in peril,” the UN states. This year marks the halfway point to the 2030 Agenda deadline, increasing global urgency to ignite progress.

The signing by Minister of Foreign Affairs Bui Thanh Son made Vietnam one of the first countries to sign the international-legally binding instrument under the 1982 United Nations Convention on the Law of the Sea (UNCLOS). It conveyed the message that Vietnam is a positive and responsible member of the international community as well as the country’s efforts to join hands with countries to deal with global issues, contributing to peace, prosperity and sustainable development.

More than 60 countries are scheduled to sign the agreement during the underway high-level week of the 78th UN General Assembly.
