Human Rights

While aid workers serving conflict-affected civilian populations depend on a set of laws to protect them, some warring parties violate these global agreements, from targeting hospitals and schools to blocking aid workers from reaching civilians with lifesaving goods and services.

But, what exactly are the rules of war and what happens when they are broken?

To find out more about international humanitarian law, known by its acronym IHL, UN News spoke with Eric Mongelard at the UN human rights office, OHCHR.

Here’s what you need to know:

Rules of war

International humanitarian law is as old as war. From passages in the Bible and Quran to medieval European codes of chivalry, this ever-growing set of rules of engagement aims to limit a conflict’s effects on civilians or non-combatants.

The laws represent “the very minimum rules to preserve humanity in some of the worst situations known to mankind,” Mr. Mongelard said, noting that the rules of war apply the moment an armed conflict has begun.

Chúng tôi cực lực phản đối việc áp dụng hình phạt tử hình trong mọi thời điểm, mọi hoàn cảnh, đây là một hình phạt tàn ác, vô nhân đạo, hạ thấp nhân phẩm và không bao giờ có thể biện minh được, đồng thời vận động Việt Nam hoãn thi hành tất cả các án tử hình.

Ngày nay, hơn hai phần ba các quốc gia trên thế giới đã trở thành những quốc gia bãi bỏ trong luật pháp hoặc trên thực tiễn, điều này khẳng định xu hướng toàn cầu ủng hộ việc bãi bỏ án tử hình. Không có bằng chứng nào cho thấy hình phạt tử hình có tác dụng răn đe tội phạm hiệu quả hơn hình phạt tù. Hơn nữa, việc cải tạo với vai trò như một mục tiêu của luật hình sự hiện đại không thể thực hiện được bằng việc áp dụng hình phạt tử hình. Không những thế, bất kỳ sai sót nào – điều không thể tránh khỏi trong bất kỳ hệ thống luật pháp nào – đều không thể đảo ngược. 

Chúng tôi sẽ tiếp tục tích cực nỗ lực để thúc đẩy xu hướng chung hướng tới loại bỏ hình phạt tử hình và sẵn sàng hỗ trợ Việt Nam trên con đường tiến tới việc xóa bỏ này.

A slowdown in progress on key areas is putting the 2030 Sustainable Development Goals ‘in peril’.

  • Multiple global crises continue to put the 2030 Sustainable Development Goals ‘in peril’, the UN says.
  • Its 2023 update report shows a significant reversal of progress in key areas such as child vaccination rates and income inequality between countries.
  • These challenges will be the focus of the World Economic Forum’s Sustainable Development Impact Meetings on 18-22 September 2023.

The 2030 Agenda for Sustainable Development was adopted by all United Nations’ (UN) member states in 2015. “A shared blueprint for peace and prosperity for people and the planet, now and into the future”, it is based on 17 Sustainable Development Goals (SDGs), which the UN describes as an urgent call for action. The organization says that ending global poverty requires focusing on strategies that reduce inequality and spur economic growth, while also tackling climate change.

The Sustainable Development Goals Report 2022 painted a worrying picture of progress in almost all areas, but the 2023 update delivers an even graver warning: “The promises enshrined in the SDGs are in peril,” the UN states. This year marks the halfway point to the 2030 Agenda deadline, increasing global urgency to ignite progress.

Vietnam becomes one of first nations to sign High Sea Treaty

Photo by Thu HongVietnam on Wednesday signed the United Nations agreement on the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction, the High Sea Treaty.

The signing by Minister of Foreign Affairs Bui Thanh Son made Vietnam one of the first countries to sign the international-legally binding instrument under the 1982 United Nations Convention on the Law of the Sea (UNCLOS). It conveyed the message that Vietnam is a positive and responsible member of the international community as well as the country’s efforts to join hands with countries to deal with global issues, contributing to peace, prosperity and sustainable development.

More than 60 countries are scheduled to sign the agreement during the underway high-level week of the 78th UN General Assembly.

Human Rights

The Independent Investigative Mechanism for Myanmar (IIMM) on Tuesday revealed compelling evidence of the country’s military and affiliate militias engaging in more frequent and audacious war crimes and crimes against humanity.

These include indiscriminate attacks on civilians from aerial bombing, mass executions of civilians and detained combatants, and large-scale and intentional burning of civilian homes and buildings, resulting in the destruction of entire villages in some cases, the Mechanism said in a news release.

The Core International Human Rights Instruments and their monitoring bodies

There are 9 core international human rights instruments. Each of these instruments has established a committee of experts to monitor implementation of the treaty provisions by its States parties. Some of the treaties are supplemented by optional protocols dealing with specific concerns whereas the Optional Protocol to the Convention against Torture establishes a committee of experts.

ICC chief prosecutor reacts to Putin arrest warrant

The International Criminal Court’s chief prosecutor believes Russian President Vladimir Putin could stand trial for alleged crimes committed during Russia’s war in Ukraine, he told CNN on Friday, despite Moscow’s arguments that it is not subject to the court’s decisions.

In an interview with CNN’s Clarissa Ward, Chief Prosecutor Karim Khan pointed to historic trials of Nazi war criminals, former Yugoslavian President Slobodan Milošević, and former Liberian leader Charles Taylor, among others.

“All of them were mighty, powerful individuals and yet they found themselves in courtrooms,” he said.
