BEIJING — Only a day before a small Chinese boat sidled up to a United States Navy research vessel in waters off the Philippines and audaciously seized an underwater drone from American sailors, the commander of United States military operations in the region told an audience in Australia that America had a winning military formula.

“Capability times resolve times signaling equals deterrence,” Adm. Harry B. Harris Jr. told a blue-chip crowd of diplomats and analysts at the prestigious Lowy Institute in Sydney, Australia, the leading city in America’s closest ally in the region.

Philippine president Rodrigo Duterte’s recent trip to Beijing yielded a number of agreements, including a vaguely-worded commitment to peacefully resolve the South China Sea disputes. But there was no public breakthrough on one closely-watched topic: the ability of Filipino fishermen to return to Scarborough Shoal. An international tribunal ruled on July 12 that China’s closure of the shoal to Philippine fishing was illegal. But in the lead-up to Duterte’s visit, Filipino fishermen complained that it was becoming more, not less, difficult for them to approach Scarborough. chathamhouse – Despite its dramatic rejection of the South China Sea arbitration case initiated by the Philippines, China is gearing up to play a much larger role in the evolution of the international legal system.

It is tempting to read China’s refusal in this case to acknowledge the jurisdiction of the arbitral tribunal in The Hague as the defiance of an arrogant superpower that views itself as above international law. No doubt many in Manila, Washington and elsewhere are purveying this view. But there is more here than meets the eye.
